3,151. May a Farmhand Gather the Leket?

Hilchos Matnos Aniyim 4:10

If a stalk of leket gets mixed with one’s grain pile, the owner must take two stalks. He takes the first and says, "If this is leket, it belongs to the needy; if it’s not leket, may the tithe I owe from this stalk be taken from the other stalk." He then makes this same statement on the other stalk, after which he gives one stalk to the needy and uses the other one in his tithes.

Hilchos Matnos Aniyim 4:11

One may not hire a worker with the intention that the worker’s son will gather the leket behind him. However, sharecroppers, tenant farmers, and those who buy standing grain to harvest may have their sons gather behind them. A farmhand may bring his wife and children to gather leket behind him. This is so even if the worker was hired with the understanding that he would receive half, one-third or one-quarter of the harvest as his wages.
