3,074. Vines on a Trellis

Hilchos Kilayim 6:12

If someone trains a vine over part of a trellis, he may not plant under the rest of the trellis; this is so even if there are no leaves or branches on them. If he did plant there, the produce remains permitted because no crops are under the shade of the vine. The same is true if one trained a vine over the branches of a tree that doesn’t produce fruit, like a cedar or a pine. However, if he trained a vine over the branches of a fruit-bearing tree, it is permitted to plant under the branches of the tree that don’t have the vine trained on it. This is because one doesn’t nullify a fruit-bearing tree’s status by using it as a trellis for a vine. If seeds were planted and the vine later extended to overhang the produce, it should be moved to a different position.

Hilchos Kilayim 6:13

If someone plants seeds under the rest of a trellis or under the other branches of a tree that doesn’t produce fruit and then the vine extended and covered the produce, one may not retain the produce, nor may he relocate the vine. Rather, he must uproot the produce.
