Hilchos Kilayim 5:20

The general rule is that if the leaves of a plant grow from its roots, it’s a vegetable; if not, it’s a tree. A caper bush is considered a tree in all ways.

Hilchos Kilayim 5:21

If someone sees a vegetable growing in his vineyard and he says that he’ll remove it when he gets there, it is permitted (for the time being, i.e., he need not make the effort to remove it immediately). Let’s say that he reaches it and passes by, saying that he’ll remove it on his way back. If he delays the length of time it would take this vegetable to increase by 1/200th, it becomes sanctified.
