2,857. Declaring an Organ a Nazir
Hilchos Nezirus 1:16
If a person declares his hand or foot to be a nazir, his statement is ineffective. However, if he declares his head or liver to be a nazir, then he is rendered a nazir. The general rule is that when a person declares an organ that he needs to live to be a nazir, he is rendered a nazir.
Hilchos Nezirus 1:17
If someone says that he’ll be a nazir when a son is born to him, then if a son is born to him, he’s a nazir. If a daughter, an intersex (hermaphrodite) baby or a child of indeterminate gender is born to him, he’s not a nazir. If he says that he’ll be a nazir when a child is born to him, then a daughter, an intersex baby and a child of indeterminate gender also render him a nazir. If his wife miscarries, he’s not a nazir; if she conceives again and then gives birth, he is a nazir.
