2,821. Is Divorce the Same as Silence?

Let’s say that the girl’s father heard about her vow but her fiancé didn’t and the fiancé died that same day, or her fiancé also heard about the vow and he annulled it or remained silent and then died that same day. In such a case, the girl returns to her father’s domain and he can annul the vow. If the fiancé heard about the vow and upheld it, after which he died that same day, or if he remained silent and died the next day, then the girl’s father cannot annul the vow.

If the fiancé divorced the girl after hearing about the vow, there is a doubt as to whether the divorce is the same as silence, which would enable the girl’s father to annul the vow along with a second fiancé who betroths her that same day. It’s possible that divorce is tantamount to her first fiancé upholding the vow, in which case the vow would stand.
