  • האיש מגלח על נזירות אביו/Using a father’s nezirus funds for himself

The next Mishnah states: האיש מגלח על נזירות אביו – A man can shave using his father’s nezirus funds for his korbanos, but a woman cannot. The Mishnah illustrates (according to the girsa of the Rosh and Tosafos) that if he and his father were both simultaneously nezirim, and his father designated money for his korbanos and died, Rebbe Yose says the son may not use those funds. The case that he may use the funds is: מי שהיה אביו נזיר – One whose father was a nazir, והפריש מעות סתומים על נזירותו ומת – and he designated unspecified money for his nezirus [korbanos] and died, ואמר הריני נזיר על מנת שאגלח על מעות אבא – and then [the son] said, “I am hereby a nazir on condition I can shave using my father’s nezirus funds,” זה הוא שמגלח על נזירות אביו – this is the one who can shave using his father’s nezirus. The Gemara explains that this exception to the general rule that one cannot use someone else’s designated funds for his korbanos is a halachah leMoshe miSinai. The Gemara will prove that other Tannaim allow him to use his father’s funds even in the first case of the Mishnah.

  • Two sons using the father’s nezirus funds

Rabbah asked: יש לו שני בנים נזירים מהו – If he has two sons who are nezirim, what is the halachah? הילכתא גמירין לה כל דקדים גלח גלח – Do we say it is a halachah [leMoshe miSinai], and does not follow laws of inheritance, so whoever [accepts nezirus] first shaves using his father’s funds? או דילמא ירושה גמירין לה ופלגא הוי – Or this was taught as an inheritance, and he may use half? Rava inquired, if we assume that they split the funds, בכור ופשוט מאי – If there is a first-born son and an ordinary son, what is the halachah? Do we say that in this halachah he does not receive more than another son,או דילמא ירושה היא, וכי היכי דשקיל פי שנים הכי מגלח – or do we say it is an inheritance, and just as he normally takes a double portion, so too he shaves using that proportion?

  • Using a father’s funds if one is a nazor olam, or nazir tamei

The Gemara inquires: אביו נזיר עולם והוא נזיר סתם – If his father was a permanent nazir (who trims his hair and brings korbanos periodically) and he was an ordinary nazir, אביו נזיר סתם והוא נזיר עולם מאי – or his father was an ordinary nazir and he was a permanent nazir, what is the halachah regarding using his father’s funds? כי גמירין הילכתא בסתם נזירות, או דילמא לא שנא – Do we say the halachah was only taught for an ordinary nezirus but not a permanent nezirus, or perhaps there is no difference? The Rosh adds that the question applies equally if both he and his father were permanent nezirim. The Gemara continues, if we assume that in the above cases he can use his father’s funds, because each is a nazir tahor, Rav Ashi inquired further: אביו נזיר טמא והוא נזיר טהור – If his father was a nazir tamei and he was a nazir tahor, אביו נזיר טהור והוא נזיר טמא מאי – or his father was a nazir tahor and he was a nazir tamei, what is the halachah regarding using his father’s funds? The Gemara leaves these questions as a teiku.
