2,782. A Third Party Prohibited by One Partner
Hilchos Nedarim 7:5
If two people jointly own a courtyard and one of them makes an oath prohibiting the other from benefitting from him, the person who made the oath is compelled by the court to sell his share. If he made an oath not to benefit from the other person, he may enter his house because he’s entering his own domain, but he may not use the courtyard in any other way, as was discussed in halacha 7:4.
Hilchos Nedarim 7:6
If a third party was prohibited to benefit from one of the courtyard’s owners, he may enter the courtyard because he can tell the one prohibited to him that he’s entering the other partner’s domain.
