2,735. Vowing by the Temple

Hilchos Nedarim 1:22

If one says, “By the Temple, I will eat of yours,” “The Temple, I will eat of yours” or “No Temple, I will eat of yours,” it is prohibited. “The Temple, I won’t eat of yours,” “Like the Temple, I won’t eat of yours” or “No Temple, I won’t eat of yours,” it is permitted because this is like taking an oath by the Temple not to eat from the other person’s property. The same is true in all comparable cases.

Hilchos Nedarim 1:23

If one person tells another, “I take a vow from you,” this implies that he won’t speak to him. If he says, “I separate from you” it suggests that he won’t do business with him. If he says, “I distance from you,” it suggests that he won’t sit within four cubits of him. (i.e., about six feet). The same idea is conveyed by saying, “I am ostracized from you” or “I am banned from you.” However, if he says “I take a vow from you not to eat of yours,” “I separate from you not to eat of yours” or “I distance from you not to eat of yours,” it is forbidden to eat from the other person’s property. If he eats the volume of an olive from the other person’s property, he is liable to the penalty of lashes for violating the prohibition against desecrating one’s word.
