2,717. When There's No Warning

Hilchos Shevuos 11:18

If the defendant and the plaintiff both wish to proceed, those present cite Numbers 16:26, “Turn away from the tents of these evil men.” The court informs the defendant that they’re not imposing the oath based on his interpretation of the words, but based on the court’s intention in the words (so that he can’t later claim that it wasn’t what he meant).

Hilchos Shevuos 11:19

While this warning isn’t given before an oath taken for a doubtful claim or an oath of enticement, the judges still impress the severity of the matter on the litigants because they might still recant and avoid the necessity for an oath altogether.
