2,707. Multiple Denials in Court

The previous halacha (about witnesses being liable for oaths imposed outside of court) applies when they responded with amen. If they didn’t answer amen, they just denied after each oath, they’re only liable if the oath was imposed in court, as has been discussed. This is because they neither took the oath themselves nor answer with amen.

Let’s say that a plaintiff imposes an oath on witnesses in court and they deny having information; he imposes an oath four or five times and they deny having information each time. In such a case, they’re only liable for an oath of testimony once. This is so regardless of whether the oath was imposed in court or elsewhere, even if they repeatedly responded amen or took the oath on their own. The reason is because once they have denied in court, they would no longer be able to testify even if they retract.
