Kesubos 3:5-6
Kesubos 3:5
The rapist is obligated to marry his victim (assuming she so desires) even if he finds something unattractive about her, such as if she is lame, blind or covered in boils. If she committed adultery or was unfit to enter the general marriage pool, he is not permitted to marry her, or to remain married. Deuteronomy 22:29 says, “She shall be his wife,” limiting it to a woman who could actually be his wife.
Kesubos 3:6
If an orphan girl was betrothed and then divorced, Rabbi Elazar says that a seducer is exempt from paying the fine (since she was a willing participant) but a rapist is obligated.
