If one person sells seed to another and it fails to grow, the seller is not held responsible, not even when it comes to flax seed (which is only bought to plant and not to eat). Rabban Shimon ben Gamliel says that a seller is held responsible for garden seeds that are planted but not eaten.
Baba Basra 6:2
If one person sells grain to another, the buyer accepts that up to a quarter kav per seah may be spoiled (that’s 1/24 of the total). When buying figs, he accepts that 10% may be wormy. If he buys a wine cellar, he accepts that 10% may have gone sour. If one buys jars in Sharon, he accepts that 10% may be brittle.
