Eduyos 4:4-5
Eduyos 4:4
If a sheaf was left near an uncemented wall, a stack of grain, cattle or tools and the owner forgot it, Beis Shammai say that it is not considered a forgotten sheaf that must be left for the needy (because it’s near a landmark, so he’ll remember it) but Beis Hillel say that it is considered a forgotten sheaf (because right now, it’s forgotten).
Eduyos 4:5
Beis Shammai say that if one wants to redeem a vineyard in its fourth year, one need not add a fifth to its value, and one need not remove its produce before Pesach (because fourth-year produce is not treated like second tithe). Beis Hillel say that one must add a fifth and it must be removed (because fourth-year produce is treated like second tithe, based similar language used by the Torah regarding both mitzvos). Beis Shammai say that the law that fallen grapes and defective clusters belong to the needy applies to fourth-year vineyards (just like a regular vineyard) and the needy must redeem the produce themselves; Beis Hillel say that all of the grapes – including those normally left for the needy – can be brought to the winepress.
