Siman - Megillah Daf 8

This Daf contains five Mishnayos that begin אין בין and draw distinctions in halachah between closely related mitzvos.

  • אין בין נדרים לנדבות אלא שהנדרים חייב באחריותן

The second Mishnah on the Daf states: אין בין נדרים לנדבות אלא שהנדרים חייב באחריותן ונדבות אינו חייב באחריותן – There is no difference between nedarim and nedavos, except that in the case of nedarim, one is responsible for them, meaning that in the event that the animal set aside as a korban dies or becomes lost, he is liable to bring another one in its place, and in the case of nedavos, one is not responsible for them. The Gemara asks for the source for this distinction and brings a Baraisa that quotes the passuk: "ונרצה לו לכפר עליו" – and it shall be accepted for him, to atone for him, and about this passuk, Rebbe Shimon explains: את ש"עליו" חייב באחריותו ואת שאינו "עליו" אינו חייב באחריותו – that which is “upon him” he is responsible to replace, and that which is not "upon him," he is not responsible to replace. When the Gemara asks how the word "עליו" – upon him, denotes personal responsibility, Rebbe Yitzchak bar Avdimi said: כיון דאמר עלי כמאן דטעין אכתפיה – Since he said “upon me” it is as if he said that burden of responsibility is on his shoulders.

  • אין בין זה הרואה שתי ראיות לרואה שלש אלא קרבן

The third Mishnah states: אין בין זב הרואה שתי ראיות לרואה שלש אלא קרבן – There is no difference between a zav who sees two emissions, which Rashi explains means that he either sees two emissions on one day, or one emission on two consecutive days, and a zav who sees three emissions, except for the chiyuv to bring a korban. A zav who has ,שלש ראיות must bring a pair of bird offerings after counting seven clean days. After the Gemara clarifies that both a zav who sees two emissions and a zav that sees three emissions are both av hatumos regarding משכב ומושב – rendering what they lie or sit on an av hatumah, and they both must count seven clean days, it asks for the source of the distinction regarding the korban. It was taught in a Baraisa: Rebbe Simai says: The passuk mentions two emissions and calls the person “tamei” and it mentions three emissions and calls the person “tamei.” If he is already tamei after two emissions, why is it necessary to call him “tamei” after three emissions? The Gemara answers, שתים לטומאה ושלש לקרבן – This teaches that the two emissions make him tamei, whereas the three emissions make him chayav in a korban.

  • אין בין מצורע מוסגר למצורע מוחלט

The fourth Mishnah teaches that the only difference between a מצורע מוסגר – confined metzora, and a מצורע מוחלט – confirmed metzora is פריעה ופרימה –  letting his hair grow, and rending his clothes. The Gemara asks for the source for this distinction, and after the first source is rejected, Rava says that the source that a מצורע מוסגר is patur from both is derived from the passuk that states, "והצרוע אשר בו הנגע" – And the tzarua that is in him the affliction, his garments shall be torn, and the hair of his head shall be uncut. This implies מי שצרעתו תלויה בגופו – that only the one whose tzaraas is in his body, and therefore requires healing, is required to tear his clothing and grow his hair long, יצא זה שאין צרעתו תלויה בגופו אלא בימים – and excludes the מצורע מוסגר whose tzaraas is not dependent on his body, but upon the days of his confinement.
