2,294. Liability for Multiple Sets of Lashes

Let’s say that a creature is a swarming thing that flies, swarming thing of the water and a swarming thing of the ground, meaning that it has wings, it walks on the ground like other swarming things and it reproduces in the water. If one eats it, he is liable for three sets of lashes. Additionally, if it’s a species that’s brought into existence in fruit, he’s liable for a fourth set. If it’s a species that reproduces, he’s liable for a fifth set. If it can be considered a non-kosher flying thing in addition to a swarming thing that flies, he’s liable for six sets. These are for eating: a non-kosher flying thing; a swarming thing that flies; a swarming thing of the ground; a swarming thing of the water; a creature that creeps on the ground; and a worm from fruit. This so whether he ate the thing in its entirety or an olive-sized portion of it. Accordingly, one who eats an ant that flies and that reproduces in the water is liable for five sets of lashes.

Let’s say that a person crushed ants, then he added a complete ant to the crushed ants, making an olive-sized portion. If he ate it, he’s liable for six sets of lashes: five sets for eating the one ant in its entirety plus one set for eating an olive-sized volume of non-kosher carcasses.
