3,575. Planting From an Orlah Tree

If a tree grows from a stump, it is exempt from orlah; from the roots, it is obligated. A miniature vine that will remain less than a handbreadth tall is obligated in orlah for its whole life; this is because it looks like it's a year old. This is when there is one such vine, or five planted two opposite two with the fifth behind them. However, if a whole vineyard is less than a handbreadth tall, it would be well known, so orlah would be counted the same as it is for other trees.

It is permitted to plant a branch from an orlah tree, but not an orlah nut. This is because it is produce from which we are not permitted to benefit, as was discussed in Maachalos Assuros 10:9. If someone violated the law and planted an orlah nut, what grows from it is permitted like other trees. (The reasoning behind this is discussed in the next halacha.)
