3,574. Extensions of Extensions of Extensions of Trees

Hilchos Maaser Sheini and Neta Revai 10:17

Let’s say that a branch was extended from a tree and planted in the ground. Later, the tree was uprooted so that it was only receiving nourishment from the branch planted in the ground. In such a case, the tree is considered planted as of when the tree was uprooted, with the result that orlah applies. This counts for both the tree and for whatever grows from the branch from the time the tree was uprooted.

Let’s say that someone extends a branch and plants it in the ground. It grows, so the owner extends that and plants a branch from the new growth in the ground. That grows, so he extends and plants a branch of that growth. If he continues in this manner even 100 times, so long as the planted branches are all connected back to the original tree, all the fruit is permitted. If the growth becomes separated from the original tree, orlah is counted from the time of separation.
