2,606. Taking the Mother Instead of Her Young

Hilchos Shechita 13:6

Even if one says that he’ll take the mother bird and send away the chicks, he’s obligated to send away the mother, as per Deut. 22:7, “You shall surely send the mother away.”

Hilchos Shechita 13:7

If he took the bird’s young and returned them to the nest, after which the mother returned, he need not send her away again; it is permitted to shoo the mother away and then to catch her. The Torah only prohibited capturing her when she can’t fly away because she’s hovering over her young to protect them, as per Deut. 22:6, “the mother is resting on the chicks.” However, if he released her from his grip and then caught her again, it is permitted.
