2,605. If the Mother Bird Returns
Hilchos Shechita 13:4
If someone took a mother bird with her young, then he cut the mother’s wings so that it can’t fly and he sent it away, he is given stripes for acting rebelliously. He must keep the mother bird until its wings heal and then send her away again. If the mother bird dies, runs away or gets lost before this happens, he is liable to lashes, because he didn’t fulfill the positive mitzvah.
Hilchos Shechita 13:5
One sends the mother away as follows: he holds her by the wings and has her fly away. If she comes back and he sends her away again and she comes back again, even if this happens four or five times, he must continue to send her away, since Deut. 22:7 is emphatic that “You shall surely send (her) away.”
