2,190. Whom an Asufi and a Shetuki May Marry

Hilchos Issurei Biah 15:32

A midwife’s word is accepted if she says that a child is a kohein, a Levi, a Gibeonite or a mamzer because the child’s lineage hasn’t yet been determined. This is the case when the midwife’s reputation has been established and no one objects. However, if even one person objects and says that she’s lying, her word is not accepted. The child is then considered valid but not a kohein or a Levi.

Hilchos Issurei Biah 15:33

It’s obvious that a shetuki may not marry another shetuki and an asufi may not marry another asufi because their statuses are in doubt. However, even definite mamzeirim and Gibeonites may marry one another, and their child is a mamzer. A shetuki and an asufi may marry Gibeonites just like they may marry other converts; their children are considered mamzeirim out of doubt.
