1,833. Marrying Prematurely

Just as one may not marry a pregnant or nursing woman during this time, one may not betroth her until this period elapses. A woman may not marry during the 24 months even if she gives her child to a wet nurse or weans him. If the child dies, she may marry; we are not concerned that a woman might kill her child in order to get married.

If a man violates the law and marries a pregnant or nursing woman before it is permitted, he should divorce her even if he is a kohein (and unable to remarry her later). If he is a Yisroel, he may remarry her after the 24 months of nursing have concluded. If he married her and then ran away, only returning after the 24-month period has concluded, there is no problem with them remaining together. If a man betroths a pregnant or nursing woman, he is not compelled to divorce her but he may not finalize the marriage until the 24-month nursing period has concluded or the child dies.
