1,807. Instructions Not to Deliver a Get for 30 Days

Let’s say that a man gives a get to an agent with instructions to deliver it to his wife. The agent replies that he doesn’t know who the man’s wife is so the man tells the agent to give the get to person X, who does know his wife. In this case, the agent hasn’t been assigned the task of effecting divorce; his role is to give the get to the one designated by the woman’s husband. That third party is the one assigned to effect divorce. He must either deliver the get or send it with another agent if he gets sick or is otherwise impeded by circumstances beyond his control.

If a man gives a get to an agent with instructions not to deliver it until after 30 days, the agent can send it through a second agent whom he appoints within the 30 days if he falls ill or is prevented by other circumstances beyond his control. Even though he appoints that second agent at a time in which his own agency is not in effect, since he will have that role after the 30 days have pass, he also has the ability to appoint a replacement within those 30 days.
