1,804. Instructions to Transfer a Get in a Particular Place

If a man tells an agent to deliver a get to his wife in a certain place, divorce is not effected if he gives it to her elsewhere. If he says to give it to his wife who can be found in a certain place, then divorce is effected even if the agent gives it to her elsewhere because he was only helping the agent to locate his wife. Similarly, if he says, “Only give it to her in the house” and the agent gives it to her in the attic, or if he says, “Only give it to her with your right hand” and the agent delivers it with his left hand, or if he says to deliver it on a certain day and the agent delivers it earlier – in all of these cases, divorce is not effected. If he says “Only give it to her on such-and-such day,” then divorce is not effected if the agent delivers the get either before that date or after it. This is because the husband specified that the get must only be delivered on that particular day. The same is true in all comparable cases.

Similarly, if a woman instructs her agent to accept a get for her in a particular place, if he accepts it for her elsewhere, divorce is not effected. If she says to bring her the get in a certain place, then the get is valid even if the agent brings it to her elsewhere.
