#432: The First Condition
1. We learned previously that one of the three conditions to qualify as the Torah melachah of tzad is that the animal can be grabbed in one motion after it is trapped. The Torah melachah of tzad applies when one traps an animal in a setting from which it cannot escape. For example, one who traps a bird in a very small space has violated the Torah melachah of tzad.
2. If one traps an animal in a location from which it can escape a human grabbing it, one violates the Rabbinic prohibition of tzad (Shulchan Aruch, O.C. 316:1). Thus, one may not close a window after a bird flies into the house because this violates the rabbinic prohibition of tzad. However, it does not violate the Torah prohibition since the bird can still fly around. Rather, one should keep a window or door open and encourage the bird to leave.
