3,773. Being Suspected in One Thing
Hilchos Shemittah v’Yoveil 8:15
One who is suspected of selling shemittah produce is not automatically suspected when it comes to second tithe. Similarly, one who is suspected of selling second tithe is not automatically suspected when it comes to shemittah. This is so even though both of them are Biblical laws. This is because each of them has its own unique stringency: Second tithe must be brought to Jerusalem, which is not the case with shemittah. Shemittah, on the other hand, can’t be redeemed, which is not the case with second tithe.
Hilchos Shemittah v’Yoveil 8:16
One who is suspected of selling ritually unclean food as ritually clean is not automatically suspected of selling second tithe or shemittah produce. This is because ritually unclean food that was misrepresented as ritually clean only renders people unclean under Rabbinic law. A person who is suspected regarding Rabbinic laws is not necessarily suspected when it comes to Biblical laws.
