3,771. Buying Arba Minim During Shemittah

Hilchos Shemittah v’Yoveil 8:11

If someone buys a lulav from an unlearned person during shemittah, he should be given the esrog as a gift. If the seller doesn’t give it to him, the price of the esrog should be included in the price of the lulav.

Hilchos Shemittah v’Yoveil 8:12

The preceding halacha applies when one is selling types of fruit that are normally guarded, such as figs, pomegranates, etc. If he sells fruit that one would assume is ownerless, then one may buy a small amount from him, namely enough for three meals. This was permitted in order to enable the seller to earn a living.
