2,608. Must One Send Away the Father Bird?

Hilchos Shechita 13:10

If a male bird is sitting on a nest, one need not send him away. If a non-kosher bird is sitting on a nest of eggs from a kosher bird, or if a kosher bird is sitting on the eggs of a non-kosher bird, one need not send it away.

Hilchos Shechita 13:11

If a kosher bird sits on the eggs of a different kosher species, it should be sent away but if one didn’t do so, he isn’t liable. If the mother’s a treifa, one must send her away.
