2,199. Who is Lashed

Hilchos Issurei Biah 17:4

If a Kohein Gadol betroths a widow and is intimate with her, he is lashed twice – once for violating the prohibition against marrying a widow and once for violating the prohibition against desecrating people of valid lineage. If a Kohein Gadol or a regular kohein marries one of the prohibited women but isn’t intimate with her, he is not lashed.

Hilchos Issurei Biah 17:5

If a kohein is lashed for prohibited relations, the woman with whom he was intimate is also lashed; if he isn’t lashed, then neither is she. There’s no difference between men and women when it comes to penalties except for a servant woman who was designated for another, as was explained in halacha 3:14.
