2,148. Relations with Canaanite Servants

If a Jewish man intentionally has sexual relations with a non-Jewish woman, she is liable for leading him to sin. This is true regardless of her age or marital status as per Numbers 31:16-17, “They were with the children of Israel following the advice of Balaam….”

Servants who have immersed and accepted upon themselves the mitzvos in which servants are obligated are no longer considered non-Jews, but rather Jews. Because of this, a female servant is prohibited to a free Jewish man – both one’s own servant woman and someone else’s. If a man is intimate with a servant woman, he is given stripes for acting rebelliously. This is a rabbinic enactment because the Torah permits a master to give a Canaanite servant woman to a Jewish servant man as per Exodus 21:4, “If his master gives him a wife….”
