1,962. A Fine vs. Lashes

If a girl was converted, redeemed from captivity or freed from indentured servitude before reaching the age of three, she is entitled to receive the fine; if she was converted, redeemed or freed at age three or older, then she is not. Since relations are legally significant after reaching the age of three, such a girl is presumed not to be a virgin.
Naarah Besulah 1:11
Let’s say that the virgin who was raped or seduced was prohibited to the man who raped or seduced her. If the prohibition is punishable by karies (spiritual excision), such as if she was his sister, aunt, a menstruant, etc., or if she was prohibited by a negative commandment, then the offender is not obligated to pay a fine if he was warned; in such a case, he receives lashes. This is because a person is never punished with both lashes and a financial penalty. If he wasn’t warned, he is not given lashes and he must pay the fine.
