1,690. Discovering a Blemish Later

Hilchos Ishus 25:6

If a man engaged in marital relations with his new wife and only after several days did he claim to discover a blemish, his words are not heeded. This is so even if the blemish is in the folds of her skin or on the bottom of her foot. This is based on the presumption that a man will not metaphorically “drink from a cup” without inspecting it first. Rather, we assume that he was aware of the blemish and consented.

Hilchos Ishus 25:7

Let’s say that a man marries a woman and learns that she doesn’t have a fixed time for her period to begin; rather, she doesn’t feel anything until it has begun. In such a case, she may only engage in marital relations if she uses a cloth to check herself before having relations and again afterwards. The husband must also check himself as we will discuss IY”H when we come to Hilchos Issurei Bi’ah (the laws of prohibited relations).
