#438: Dangerous Animals

1. Over the last few days, we learned about one of the exceptions to the conditions of trapping – domesticated animals are generally not included. A second exception is that it is permitted to trap animals or insects that pose any sort of danger. In addition, it is also permitted to trap animals that could cause harm to a person, even if it does not pose danger to life (Shulchan Aruch, O.C. 316:7 and Mishnah Berurah 316:27; Aruch Hashulchan, O.C. 316:19). Accordingly, one may trap a snake on Shabbat of any type (Yalkut Yosef, O.C. 316:5).

2. One may not trap insects or animals that merely cause discomfort or minor pain (Shulchan Aruch HaRav 316:8). Accordingly, in most cases, one may not trap an insect that bites but does not cause serious harm, such as a flea or mosquito. If it is on one’s arm already or about to bite, then it is permitted to trap them (such as by placing a cup over it), but one may not kill them (Mishnah Berurah 316:37; Shemirat Shabbat K'hilchatah 25:3). One may rule more leniently in cases where a mosquito may bite someone who will suffer an allergic reaction or if there is a significant chance that it is carrying a serious disease (e.g., there is a warning in the area for West Nile Virus).
