#435: Domesticated Animals
1. Last week, we learned about the main conditions needed for an act to qualify as the Torah prohibition or rabbinic prohibition of trapping. However, there are many exceptions to these rules, many of which we will learn about in the coming days. The first is that domesticated animals may be trapped normally. Thus, cows, horses, and the like may be trapped in any location, since they do not resist confinement and capture, and they willingly submit to human control (Shulchan Aruch, O.C. 316:12 and Mishnah Berurah 316:52).
2. If the domesticated animals actively resist capture, which occasionally occurs with such animals, actively trapping is considered a Torah prohibition (Mishnah Berurah 316:59). If such an animal escapes but will certainly return back at night, one who catches it violates the rabbinic prohibition of trapping (Mishnah Berurah 316:56).
