#356: Performing Melachah for a Choleh She'ein Bo Sakanah
1. We mentioned previously that one may ask a non-Jew to perform melachah (even Torah level prohibitions) for a choleh she’ein bo sakana. However, a Jew may not perform melachah on his behalf.
2. The Shulchan Aruch quotes multiple views as to whether a rabbinic prohibition may be violated by a Jew on behalf of a choleh she’ein bo sakanah (328:17), such as when a non-Jew is not available. The most accepted opinion is that it is permitted, but only when performed with a shinui (in an unusual manner) (Mishnah Berurah 328:57). One should consult a rabbinic authority for more specific guidance as to what constitutes a Torah or rabbinic prohibition, as well as what constitutes a shinui, since cases vary and the rules can sometimes be complex.
