3,813. When Yoveil Arrives During the Year

Let’s say that someone consecrated a house in a walled city and someone else redeemed it from the Temple. If a year passes from the time it was redeemed from the Temple and it hasn’t been redeemed by the original owner, it becomes the permanent property of the one who redeemed it from the Temple. This is because the Temple doesn’t become the permanent owner; the one who redeemed it from them does. This is derived from Leviticus 25:30: “the one who bought it for his posterity” (i.e., descendants, limiting this rule to a human owner).

If someone sells a house in a walled city and yoveil arrives within that first year, the house doesn’t return to its owner due to yoveil. Rather, it stays with the buyer until the seller decides to redeem it in that first year or it becomes the permanent property of the buyer after that year has passed.
