3,682. One Wife Who Has Given Birth Before and One Who Hasn't

Let’s say that a man has two wives, one who has previously given birth and one who has not yet given birth. They give birth to two boys who get mixed up. In such a case, the father must give five sela to a kohein. If one of the babies dies within thirty days of birth, the father need not pay. If the father dies, five sela must be paid from his estate.

Regarding the case in the preceding halacha, if the man’s two wives give birth to a boy and a girl, or to two boys and a girl, the priest isn’t owed anything. This is because it’s possible that the wife who never gave birth before gave birth to the girl first and that the boy was born to the wife who had previously given birth.
