3,599. Owning Both the Fruit and the Land
Hilchos Bikkurim 2:13
If someone buys a tree in another person’s field, he doesn’t bring first fruits because he doesn’t own the land; if he buys three trees, he owns the land. Even though he only owns the trees, it’s as if he owns the land. If he bought one tree with the land around it, he brings first fruits.
Hilchos Bikkurim 2:14
If someone bought harvested fruit along with the land where it grew, he brings first fruits because he owns both the produce and the land. If one person sells another fruit without the land, he doesn’t bring first fruits even if the fruit is still attached to the ground. The seller doesn’t bring them because he doesn’t own the fruit, and the buyer doesn’t bring them because he doesn’t own the land. If the seller purchases the fruit from the buyer, then he brings first fruits because he owns both the fruit and the land.
