1,025. A Woman Remarrying

145:13 A woman who has been widowed or divorced may not marry another man until she has waited ninety days, not including the day of her divorce or the death of her husband and not including the day of the wedding. (Editor's note: the reason is to ensure that she's not pregnant, to avoid questions of paternity.) Even if she can no longer have children, or her first husband was overseas or in prison, it makes no difference. Even if she had a miscarriage in the meantime, it does not affect this rule. Even to set her up with someone is prohibited, unless the suitor promises not to go into her home during this time. However, a man who remarries a woman he divorced need not wait at all.

145:14 If a woman is pregnant or nursing, she may not marry another man until the baby is 24 months old. Even if she gave birth after she was divorced or widowed and she has not yet started to nurse, she must wait. If this creates a serious difficulty, a Torah authority must be consulted.
