3,404. What Kind of Courtyard Obligates Produce in Tithes?

A courtyard that obligates produce in tithes is one in which utensils are protected, a person would not be embarrassed to eat, or one who enters would be asked his business (i.e., it’s clearly private property). The same is true of a courtyard that has two residents or that is owned by two partners so long as if one of them unlocks it and enters, the other either enters or he leaves and locks it. Since the joint owners lock and unlock the courtyard, it obligates produce in tithes.

Hilchos Maaser 4:9

The gatehouse to a courtyard, a portico and a porch follow the same rules as a courtyard; if such a courtyard would obligate produce in tithes, then so would one of these structures. If a courtyard wouldn’t, then neither will the structure.
