3,399. Finding Fruit Under a Tree

Hilchos Maaser 3:23

Regarding ant holes next to a pile of grain that must be tithed, if they were there overnight, the kernels found in them must be tithed because the ants clearly took from the produce during the night.

Hilchos Maaser 3:24

If someone finds olives under an olive tree or carobs under a carob tree, they must be tithed because we assume that they came from that tree. If one found figs under a fig tree, there’s a doubt as to whether they came from this tree or from figs that were already tithed. This is because their appearance changes and they get dirty in the dust.
