• Why Rebbe Eliezer considers a כוות דבורים – beehive like קרקע

A second attempt is made to identify where Rebbe Eliezer said that anything which was fashioned and then attached is considered קרקע. A Mishnah discusses a כוורת דבורים – beehive, which the Gemara assumes was attached to the ground. Rebbe Eliezer says: הרי היא כקרקע – it is [halachically] like land (and can be acquired with money, a שטר, or chazakah), one may write a פרוזבול for a loan on its basis, the beehive (including its honey) is not susceptible to tumah while in its place, והרודה ממנה בשבת חייב חטאת – and one who breaks honey out of it on Shabbos is liable to bring a chatas, for קצירה – reaping. [The Chochomim disagree with all these rulings]. This proves Rebbe Eliezer holds that anything attached to the ground is considered קרקע!? The Gemara answers that Rebbe Eliezer’s opinion is based on a derashah: "ויטבול אותה ביערת הדבש" – and he dipped it into the “forest” of honey, teaching: מה יער התולש ממנו בשבת חייב חטאת – just as with a forest, one who detaches something from it on Shabbos is liable for a chatas, אף דבש הרודה ממנו בשבת חייב חטאת – so too with honey, one who breaks it off from the hive on Shabbos is liable for a chatas (even if it is not physically attached).

• Machlokes if דף של נחתומין is susceptible to tumah

The Gemara presents a Mishnah: דף של נחתומין שקבעו בכותל – regarding a baker’s board (either for preparing dough, or for displaying bread for sale) which was attached to a wall, Rebbe Eliezer rules it is not susceptible to tumah, because it is considered part of the wall. The Chochomim say it is susceptible to tumah. Since no distinctions are made, they apparently argue both where the board was planed before it was attached, as well as after. Thus, neither Tanna agrees with the Baraisa on the previous Daf about a pipe disqualifying a mikveh, which distinguishes between whether it was hollowed before or after it was attached to the ground!? After proving this Mishnah is discussing a דף של מתכת – metal board, which is Biblically susceptible to tumah (when detached), the Gemara answers that the Rabbonon here can agree to the distinction of the water pipe, because שאני שאיבה דרבנן – the law of “drawn water” which disqualifies this mikveh is different, because it is only Rabbinical and more lenient. Still, if it was first hollowed out, it disqualifies the mikveh, דאיכא תורת כלי עליו בתלוש – because it had the status of a vessel while detached.

• Is rainwater that one wanted to wash his attached mill-ring able to be מכשיר seeds?

Rav Yosef asked: מי גשמים שחשב עליהם להדיח את האיצטרובלין – Rainwater which one consciously intended to wash his mill-ring (the frame which is fixed around the base of a mill), מהו לזרעים – what is the halachah regarding its rendering seeds susceptible to tumah? Any water which the food’s owner wanted for some purpose renders food susceptible to tumah (even if he was not pleased with the water’s contact with his food), provided that purpose did not involve קרקע. According to Rebbe Eliezer, who said that anything attached to the ground is considered קרקע (and even an attached mortar is sold with a house), it is obvious that this rainwater would not render the seeds susceptible to tumah, since a mill-ring is considered קרקע. The question is relevant according to the Rabbonon, who say an attached mortar is not sold with a house, but a mill-ring is sold. Do they consider both items, which were fashioned and then attached, as מטלטלין (yet the mill-ring is sold, because it is designed to be fixed in the ground with this house)? Or do they consider both to be like קרקע (but the mortar is not sold, because מוכר בעין רעה)? The question is left unresolved.

Siman – Sew (Tailor)

The tailor who just finished sewing a picture of a beehive on a shirt with the word  "כקרקע"underneath and planned to keep it on a metal baker board attached to the wall, was dismayed when it got wet from rainwater which bounced off a mill ring onto it and some nearby seeds on the floor.
