2,598. A Hybrid Animal and Its Young

Continuing from the previous halacha, if the second animal is slaughtered to an idol, the one who slaughtered it isn’t liable to lashes for “it and its offspring” because he’s liable to execution for idolatry. However, if he was warned about “it and its offspring” and not warned about idolatry, then he’s liable to lashes rather than execution.

The prohibition of “it and its offspring” only applies to kosher domesticated species, as the Torah verse prohibiting it is discussing oxen and sheep. It applies to hybrids so if a male deer mates with a female goat, one would be liable for slaughtering the goat and its young on the same day. However, if a male goat mates with a female deer, it would be prohibited to slaughter the deer and its offspring on the same day but one would not be liable to lashes for doing so since the Torah prohibits slaughtering a cow and her young, not a deer and her young.
